Bankruptcy Counseling and Certification
Bankruptcy is a choice that will have an effect on the rest of your life and is not a decision that should be
taken lightly. With the enactment of the Bankruptcy Abuse Prevention and Consumer Protection Act it
has also become even more complex. Among the provisions of the new law are mandatory counseling
courses each consumer must fulfill:

Counseling Requirement 1: An individual may not be a debtor under this title unless such individual
has, during the 180-day period preceding the date of filing of the petition by such individual, received
from an approved nonprofit budget and credit counseling agency an individual or group
briefing (including a briefing conducted by telephone or on the Internet) that outlined the opportunities
for available credit counseling and assisted such individual in performing a related budget
analysis.

Counseling Requirement 2: Once an individual has filed their bankruptcy petition
the debtor is to complete an approved instructional course concerning personal
financial management This approved course must be completed prior to
the consumer being eligible to receive their bankruptcy discharge. |
